Yesterday, Thursday, June 18, 2020, ALSC published a story that a Federal High Court in Abuja presided over by Justice S U Bature ordered the All Progressives Congress, APC to recognise Victor Giadom as the acting national chairman of the party.
The order issued on Thursday restrained APC from blocking Giadom from performing his duties as the acting chairman.
“AN INTERIM ORDER of this Honourable Court allowing Chief Victor Giadom (present Acting National Secretary) to pilot the affairs of the 4th Defendant as Acting Chairman and to preside at all meetings of the National Executive Committee pending the decision of the National Executive committee of the 4th Defendant fixed for 17th March 2020 or any other subsequent adjourned date pending the hearing and determination of the Motion on Notice.”
“AN INTERIM ORDER of this Honourable Court restraining the 4th Defendant and its officers or anyone purporting to act as an officer of the 4th Defendant from preventing or in any way disturbing Chief Victor Giadom (present Acting National Secretary) from functioning as the Acting Chairman (unless otherwise decided by the National Executive Committee of the 4th defendant) pending the hearing and determination of the Motion on Notice,” the order stated.
However, nearly 24 hours after the Abuja ruling, a state High Court sitting in Port Harcourt, Rivers State, has declared the same Victor Giadom, cannot be the Acting National Chairman of the party.
The court presided over by Justice Florence Fiberesima granted an order of perpetual injunction restraining Giadom from parading himself as a member of the National Working Committee (NWC) of the APC in a suit filed by Dele Moses & Others.
Wechie Livinstone, the Media Adviser to the APC Acting Chairman in Rivers State, Igo Aguma, confirmed that the court ordered the APC not to recognize Giadom named as the third defendant in the case as a member of the NWC.
The court also granted an order restraining Giadom from issuing, signing or endorsing any document or correspondence to the Independent National Electoral Commission (INEC) or any other body or institution in the capacity of the National Chairman or Acting National Chairman of the APC or howsoever as an officer of the APC.
